We applaud the unanimous decision of the Federal Court.
Ms Indira's ex-husband, Mr Mohd Riduan Abdullah, formerly K. Pathmanathan, converted the three children three weeks after he embraced Islam.
The Ipoh High Court had allowed her judicial review bid to quash her children's conversion.
Indira previously secured a mandamus order compelling then IGP Tan Sri Khalid Abu Bakar to retrieve Prasana and return the child to her mother. Custody was also a battle - the civil courts awarded it to Indira, whereas the Sharia courts sided with Riduan.
MCA also applauds the wisdom and just judgment of the five-panel Federal Court bench which unanimously ruled that the definition of "parent" should be plural. Last August, the country's parliament failed to pass a bill banning the unilateral conversion of children amid opposition from conservative Muslims.
Justice Tan Sri Zainun Ali, who wrote the judgment, said the court concluded that the word "parent" should not be construed literally and referred to both the mother and father.
POLICE have no more excuses but to locate Prasana Diksa, M. Indira Gandhi said of her youngest daughter after the Federal Court today nullified the unilateral conversion of her three children to Islam. "He has to act now", Gandhi said of the police inspector-general. However, the ruling was reversed by the Court of Appeal. So, he (the IGP) can't say that he can't do anything.
"Where a decision of such significance as the conversion of a child is made, it is undoubtedly in the best interests of the child that the consent of both parents must be sought", Zainun said.
"This is the order of the High Court".
National Human Rights Society (Hakam) chairman Ambiga Sreenevasan said yesterday's ruling not only enshrines the federal constitution but also gives the priority to the children involved in unilateral conversion. She has been with her father since March 2009, when he took her away and left Indira Gandhi. They often turn to Sharia courts - existing parallel to the civil courts - to settle family and other personal matters.
In 2016, the Federal Court ordered the IGP to arrest Riduan for contempt of court. I really want to hold her, it's been nine years.
"We have gone through so much".
"The sad part is my daughter is still missing, I can't see her". It has been nine years. "Even when we have won this case, she is not with us", Indira told journalists outside the courtroom. "Especially this moment that I have been fighting for".
Monday's ruling, which followed a almost decade-long court battle, declared a Muslim court's certification of conversion for the three children - now ages 20, 19 and 9 years old - to be null and void. Now 20 and 19, they have been with Indira Gandhi all the while in keeping with the civil High Court's decision to grant her custody.
Most importantly, the Federal Court stated that the civil courts have jurisdiction over constitutional issues, interpretation of laws and judicial reviews of administrative actions, and this is a function that can not be abrogated or altered by Parliament.
